Appeals Court Denies McIver’s Immunity in ICE Assault Lawsuit

On August 26, 2026, a federal appeals court ruled 2-1 that New Jersey Democrat Rep. LaMonica McIver must face trial on two of three charges for allegedly striking and pushing past ICE agents while trying to interfere with Newark Mayor Ras Baraka’s arrest in May 2025. The court found her physical actions fell outside the Constitution’s Speech or Debate Clause protection for legislative oversight.
